CONSTITUTIONAL CORNER
In the 1100 Charter of Liberties, Englishmen now had 14 promises from the king in writing, and if they were violated, the people had a right to resist.
Number one on that list was a promise that the church would be free and independent.
Unfortunately, only a hundred years later, the people had to remind King John (from the Robin Hood legends) of that promise. When Stephen Langton was chosen to be bishop, King John wanted a different man. This was a clear violation of the 1100 Charter of Liberties, and is the beginning of the principle of ‘separation of church and state.’
Because of many abuses, in 1215 the nobles demanded that King John sign the second great charter known as Magna Carta. It is worth noting that this document was written by the people to the king…a “we the people” movement. The Magna Carta created a Royal Council to hold the king in check. This council of 25 barons was the forerunner of Parliament, and the beginning of separation of powers (executive, legislative, judicial).
Magna Carta gave:
- Right of no taxation without consent of the Royal council
- Clauses 38-40 secured due process (our 4th -8th amendments in the Bill of Rights)
- Clause 61 secured the right of the people to petition the king for a redress of grievances (our 1st amendment in the Bill of Rights).

“We must never cease to proclaim in fearless tones the great principles of freedom and the rights of man which are the joint inheritance of the English-speaking world and which through Magna Carta, the Bill of
Rights, the Habeas Corpus, trial by jury, and the English common law find their most famous expression in the American Declaration of Independence.”
Winston Churchill
